WILSON LEATHER FOOTBALL LIMITED WARRANTY POLICY

Thank you for buying this WILSON leather football. Wilson distributes its leather footballs through its worldwide network of authorized WILSON distributors and retailers and on the Wilson Football Online Store at: http://www.wilson.com/en-us/football/custom/intro/.

 

You will find herein all of the warranty policy details offered by WILSON regarding Wilson leather footballs ("the Product(s)").

PLEASE READ THESE WARRANTY TERMS AND CONDITIONS CAREFULLY BEFORE USING YOUR WILSON PRODUCT. BY USING THE PRODUCT, YOU ARE CONSENTING TO BE BOUND BY THE FOLLOWING WARRANTY TERMS AND CONDITIONS.

This warranty policy is valid as of August 9, 2011.

I. Limited Warranty

WILSON provides this warranty to customers and consumers who purchased WILSON Products from WILSON or one of it authorized retailers. WILSON warrants all new Products to be free from manufacturing or material defects ("Defects") for the Warranty Period as defined below. This warranty applies only against Defects discovered within the Warranty Period and extends only to the original purchaser of the Product.

This warranty is valid and enforceable only in the country where the Product was purchased by the original purchaser, provided that WILSON has intended that the Product be offered for sale in that country. Depending on the country, particular and variable warranties may apply in relation to applicable legislation. Nothing in this warranty policy can exclude or limit these statutory provisions.

Warranty Period

The Warranty Period for the Product is one (1) year. The Warranty Period starts on the date of the retail purchase of the Product by the original purchaser from an authorized Wilson dealer.

To the extent permitted by national laws, the Warranty Period will not be extended, renewed or otherwise affected by the subsequent resale, repair or replacement of the Product. However, part(s) repaired or replacement Product(s) issued during the Warranty Period will be warranted for the reminder of the original Warranty Period only; provided, such replacement or repair has been performed by WILSON.

Depending on the country, particular and variable Warranties Periods may apply in relation to applicable legislation. Nothing in this warranty policy can exclude or limit such legislation.

II. Conditions and Restrictions

This warranty is valid only in accordance with the conditions set forth below:

1. This warranty applies to the WILSON Product only while:

a. It remains in the possession of the original purchaser and proof of purchase from WILSON or an authorized WILSON dealer is demonstrated;

b. It has not been subjected to accident, misuse, abuse, improper service, or non-WILSON repair or modification;

c. The date code on the Product is legible and has not been removed, deleted or altered; and

d. Claims are made within the applicable Warranty Period.

2. This warranty does not cover damages due to:

a. Improper use of the Product;

b. Normal wear and tear of the Product, including minor damage such as scratches, blemishes, or other superficial damage which do not affect use or normal operation of the Product;

c. Poor care of the Product including prolonged exposure to inclement weather; or

d. Non-WILSON modification of the Product.

3. THIS WARRANTY COVERS DAMAGE TO FOOTBALL LACES, STITCHING OR BLADDER ONLY AND DOES NOT COVER DAMAGE TO THE FOOTBALL COVER MATERIAL.

4. THIS WARRANTY DOES NOT COVER PRODUCTS PURCHASED FROM AUCTION WEBSITES SUCH AS eBAY or eBID. PROOFS OF PURCHASE FROM AUCTION WEBSITES WILL NOT BE ACCEPTED.

 

III. Warranty Enforcement

WILSON shall determine in its sole discretion whether or not a Product fails to conform to its warranty. In the event of that WILSON determines that a Product fails to conform to its warranty, WILSON will provide, at its option, one of the following at no charge to the original purchaser: (a) repair of the Product or (b) replacement of the Product. The appropriate remedy will be determined by WILSON based upon the following considerations: (a) the value of the Product with no Defect, (b) the significance of the Defect, and the inconvenience each remedy would place on the original purchaser. THESE SHALL BE THE SOLE AND EXCLUSIVE REMEDIES OF THE BUYER FOR ANY BREACH OF WARRANTY.

IV. Disclaimer and Release

The warranties provided herein are the exclusive warranties given by WILSON and supersede any prior, contrary or additional representations, whether oral or written. ANY IMPLIED WARRANTIES, INCLUDING THE WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE THAT APPLY TO ANY PRODUCTS OR PARTS

DESCRIBED ABOVE ARE LIMITED IN DURATION TO THE PERIODS OF EXPRESS WARRANTIES GIVEN ABOVE FOR THOSE SAME PRODUCTS OR PARTS. WILSON HEREBY DISCLAIMS AND EXCLUDES THOSE WARRANTIES THEREAFTER. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. WILSON ALSO HEREBY DISCLAIMS AND EXCLUDES ALL OTHER OBLIGATIONS OR LIABILITIES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, WITH RESPECT TO ANY NONCOMFORMANCE OR DEFECT IN ANY PRODUCT, INCLUDING BUT NOT LIMITED TO: (A) ANY OBLIGATION, LIABILITY, RIGHT, CLAIM OR REMEDY IN TORT, WHETHER OR NOT ARISING FROM THE NEGLIGENCE OF WILSON OR ITS SUPPLIERS (WHETHER ACTIVE, PASSIVE, OR IMPUTED); AND (B) ANY OBLIGATION, LIABILITY, RIGHT, CLAIM, OR REMEDY FOR LOSS OF OR DAMAGE TO ANY EQUIPMENT. This disclaimer and release shall apply even if the express warranty set forth above fails of its essential purpose.

V. Exclusion of Consequential and Incidental Damages.

WILSON AND/OR ITS SUPPLIERS SHALL HAVE NO OBLIGATION OR LIABILITY, WHETHER ARISING IN CONTRACT (INCLUDING WARRANTY), TORT (INCLUDING ACTIVE, PASSIVE, OR IMPUTED NEGLIGENCE AND STRICT LIABILITY), OR OTHERWISE, FOR DAMAGE TO THE PRODUCT, PROPERTY DAMAGE, LOSS OF USE, LOSS OF REVENUE OR PROFIT, COST OF CAPITAL, COST OF SUBSTITUE PRODUCT, ADDITIONAL COSTS INCURRED BY PURCHASER (BY WAY OF CORRECTION OR OTHERWISE) OR ANY OTHER INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGESS, WHETHER RESULTING FROM NONDELIVERY OR FROM THE USE, MISUSE, OR INABILITY TO USE THE PRODUCT. This exclusion applies even if the above warranty fails of its essential purposes and regardless of whether such damages are sought for breach of warranty, breach of contract, negligence, or strict liability in tort or under any other legal theory. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

This warranty gives you specific legal rights, and you may have other rights, which vary from jurisdiction to jurisdiction.

All products should be sent via FedEx Ground, FedEx, or UPS to ensure that the shipment can be traced. Include with your shipment, your return address, a short note of explanation and a

photocopy of the sales receipt as originals will not be returned. RECEIPTS FROM AUCTION WEBSITES WILL NOT BE ACCEPTED. Shipping costs and insurance to WILSON are your responsibility. WILSON will inspect the returned product and take the appropriate action with 10-15 business days of receipt of the product.

If Product falls outside the Warranty Period, WILSON offers a football repair service at a cost of $20.00 per football; provided, the Product can be repaired. One of our technicians will replace the bladder and relace the ball for you, and then return it to you at our expense via UPS Ground. The repair and return process usually takes between two and four weeks.
