Japan FTC Commitment

Notice Based on the Plan for Measures to Ensure Exclusion Approved by the Japan Fair Trade Commission

After receiving a notification from the Japan Fair Trade Commission (“JFTC”) to the effect that Wilson Sporting Goods Co. (“Company”) was alleged to be in violation of the Japanese Antimonopoly Act, the Company prepared a plan regarding measures necessary to ensure that the actions below that were the grounds for the said allegation have been eliminated and submitted an application to the JFTC for the approval of such plan. Accordingly, the Company obtained the approval for the plan from the JFTC on March 25, 2022.

 Based on the Company’s acknowledgement that the JFTC did not find that the conduct described in the notification violates the provisions of the Japanese Anti-Monopoly Act, the Company in cooperation with the JFTC takes the measures herein.

The Company announces that it has decided the following matters by unanimous written consent of Board of Directors on April 27, 2022, based on the approved Plan for Measures to Ensure Exclusion of alleged actions.

  1. The Company confirms that it has already ceased the alleged violation specified in the notification and will refrain from committing the same said acts with respect to Tennis Racquets [*Note 1] sold to Japan and implement these measures for the next three years.
  2. Even without a request from ASJ mentioned in the notification, the Company will not enforce any policy with respect to Japan that prohibits any authorized retailers of the Tennis Racquets located outside of Japan [Note 2] from selling the Tennis Racquets to Parallel-Importers located in Japan in response to a request from Parallel-Importers located in Japan for resale of such Tennis Racquets to consumers in Japan, and continue the same for the next three years.


[*Note 1] Legitimate/non-counterfeit Wilson performance tennis racquets which are one type of hard ball tennis racquets for advanced players manufactured by the Company and sold through the Company or affiliated companies of the Company group (including ASJ). [*Note 2] Retailers who are located outside of Japan and approved by the Company to sell Tennis Racquets to customers outside of Japan.
